Scope of this privacy policy

This privacy policy applies only to the actions of Turps Film Limited and Users with respect to this Website. It does not extend to any websites that can be accessed from this Website, including any links we may provide to social media websites.

For the purposes of the applicable Data Protection Laws, Turps Film Limited is the “data controller”. This means that Turps Film Limited determines the purposes for which, and the manner in which, your Data is processed.

Data we collect

When you send us an enquiry through the Website, we collect the details you give us: your name, email address, organisation, phone number, what you need help with, an approximate budget, a delivery date, details of your project and how you heard about us. You only have to fill in the fields marked as required.

When you contact us in other ways, or work with us, we may also hold your job title and other contact details.

If you agree to statistics or marketing cookies, we also collect information about your visit automatically: pages viewed, how you arrived on the Website, your approximate location, and your device and browser type.

How we collect Data

We collect Data in the following ways: data given to us by you, for example when you send an enquiry through the forms on our Contact and Get a Quote pages, contact us by telephone, post or email, make payments to us, or use our services; and data collected automatically about your visit to the Website, through Cookies and similar technologies, but only where you have agreed to them (see the Cookies section below).

Enquiries sent through the Website are emailed to us and also saved in the Website’s database, so nothing gets lost.

Our use of Data

We use your Data to reply to your enquiry, prepare a quote and, if you become a client, plan and deliver your project. We do this because it is in our legitimate interests, and because you have asked us to take these steps before entering into a contract with us.

We also use Data for internal record keeping and to improve our services. Where you have agreed to statistics or marketing cookies, we use the information they collect to understand how the Website is used and to measure whether our Google Ads lead to enquiries. You can withdraw that consent at any time (see the Cookies section below).

We may use your Data for these purposes if we deem it necessary to do so for our legitimate interests. If you are not satisfied with this, you have the right to object in certain circumstances (see “Your rights” below). We do not sell your Data.

Who we share Data with

We may share your Data with our employees, agents and/or professional advisors, in order to obtain advice from professional advisers.

We also use trusted service providers who process Data on our behalf to run the Website and our business: our web hosting provider in the UK, which also stores enquiries sent through the Website; our email provider; Cloudflare, which helps deliver the Website securely; and, only if you agree to the relevant cookies, Google (Google Analytics and Google Ads) and Microsoft (Clarity).

Some of these providers are based outside the UK. Where Data is transferred outside the UK, they use safeguards recognised under UK law, such as the International Data Transfer Agreement or the UK Extension to the EU-US Data Privacy Framework.

Keeping Data secure

We use technical and organisational measures to safeguard your Data, including controlling access via unique usernames and passwords, and storing Data on secure servers.

If you suspect any misuse, loss of, or unauthorised access to your Data, please contact us immediately at [email protected].

For guidance on protecting your information online, visit www.getsafeonline.org, a resource supported by HM Government and leading businesses.

Data retention

We keep enquiries for up to two years after our last contact with you. If you become a client, we keep your contact details and project records for six years after our work together ends, for legal, tax and accounting reasons.

Unless a longer retention period is required or permitted by law, we will only hold your Data for the period necessary to fulfil the purposes outlined in this privacy policy, or until you request that it be deleted. Even after deletion, Data may persist on backup or archival media for legal, tax or regulatory purposes.

Your rights

You have the following rights in relation to your Data: the right to access copies of the information we hold about you; the right to correct inaccurate or incomplete Data; the right to erase your Data; the right to restrict our use of your Data; the right to data portability; and the right to object to our use of your Data, including where we rely on legitimate interests.

To exercise any of these rights, or withdraw consent to processing, contact us at [email protected].

If you are not satisfied with how we handle a complaint, you may refer it to the Information Commissioner’s Office (ICO) at ico.org.uk.

Links to other websites

This Website may, from time to time, provide links to other websites. We have no control over such websites and are not responsible for their content. This privacy policy does not extend to your use of such websites – please read their own privacy policies before using them.

Changes of business ownership and control

Turps Film Limited may, from time to time, expand or reduce our business, which may involve the sale or transfer of control of all or part of the business. Data provided by Users will, where relevant, transfer along with that part of the business, and the new owner will be permitted to use the Data for the purposes for which it was originally supplied. We will take steps to ensure your privacy is protected throughout.

Cookies

This Website uses Cookies and similar technologies. When you first visit, a banner asks for your consent: you can accept, deny, or choose which types to allow. Only strictly necessary Cookies are used until you decide, and you can change your choices at any time with the “Manage consent” button on every page.

Strictly necessary – required for the Website to work, for example remembering your cookie choices.

Statistics – Google Analytics and Microsoft Clarity, which help us understand how visitors use the Website so we can improve it.

Marketing – Google Ads conversion tracking, which tells us whether our adverts lead to enquiries.

The full list of Cookies, what they do and how long they last is in our Cookie Policy. You can also block or delete Cookies through your browser settings; see aboutcookies.org for guidance.

Embedded videos and Instagram

Our films are hosted on Vimeo and YouTube and play on the Website through their players, including the short previews on our project cards. Our homepage also shows recent posts from our Instagram account. When a film or post loads, the provider (Vimeo, YouTube or Instagram, part of Meta) receives information such as your IP address and may set its own Cookies, under its own privacy policy. We use Vimeo’s “do not track” option, which stops Vimeo tracking your visit, and YouTube’s privacy-enhanced mode for the previews.

General

You may not transfer any of your rights under this privacy policy to any other person. We may transfer our rights where we reasonably believe your rights will not be affected.

If any provision of this privacy policy is found invalid, illegal or unenforceable, that provision will be deemed deleted to the extent required, without affecting the remaining provisions.

This privacy policy is governed by and interpreted according to the law of England and Wales, and all disputes are subject to the exclusive jurisdiction of the English and Welsh courts.

Changes to this privacy policy

Turps Film Limited reserves the right to change this privacy policy as we may deem necessary, or as required by law. Any changes will be posted on the Website, and you are deemed to have accepted the terms of the privacy policy on your first use of the Website following any alterations.

You may contact Turps Film Limited by email at [email protected].
